These Terms of Service ("Terms") govern your use of the Testimoniq website and service operated by Testimoniq ("we", "us", or "our"). By accessing or using Testimoniq, you agree to be bound by these Terms.

1. Service Description

Testimoniq is a software-as-a-service platform that enables users to collect, manage, and display customer testimonials on their websites. The service includes testimonial collection forms, embeddable display widgets, analytics, and video testimonial support.

2. Account Responsibilities

By creating an account, you agree to:

• Provide accurate and complete information during registration.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.

You must be at least 18 years of age to create an account and use the service.

3. Acceptable Use

You agree not to use Testimoniq to:

• Submit or display fraudulent, misleading, or fabricated testimonials.
• Violate any applicable laws or regulations.
• Infringe on the intellectual property rights of others.
• Distribute malware, spam, or other harmful content.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Use the service in any way that could damage, disable, or impair its functionality.

We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions and Billing

Testimoniq offers free and paid subscription plans. For paid plans:

• Subscriptions are billed on a recurring monthly basis through Stripe.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• No refunds are provided for partial months or unused portions of a subscription period.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified before any price change takes effect.
• If payment fails, we may suspend access to paid features until payment is resolved.

5. Intellectual Property

Your content: You retain full ownership of all testimonials, text, images, and video content that you or your customers submit to Testimoniq. By using the service, you grant us a limited, non-exclusive license to host, display, and distribute your content solely for the purpose of providing the Testimoniq service.

Our service: The Testimoniq name, logo, website design, and underlying software are our intellectual property. You may not copy, modify, or distribute any part of the Testimoniq service without our written permission.

6. Limitation of Liability

Testimoniq is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the service.

Our total liability for any claim arising from or related to the service shall not exceed the amount you paid us in the twelve months preceding the claim.

7. Termination

Either party may terminate this agreement at any time:

• By you: You may delete your account at any time through the dashboard or by contacting support. Upon deletion, your data will be removed within 30 days.
• By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay for a paid subscription. We will provide reasonable notice when possible.

8. Changes to These Terms

We may update these Terms from time to time. We will notify users of significant changes by posting a notice on our website or sending an email. Your continued use of Testimoniq after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you should stop using the service and delete your account.

9. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
